These Terms of Service govern the relationship between Fwankies Auto Transport LLC and every customer who requests a quote, books a vehicle move or otherwise uses the website at www.fwankieautotransport.lat. The company arranges the shipping of cars, trucks, motorcycles and ATVs and provides carrier dispatch from its yard at 1035 Hemlock Cir, St George - 84790-6806, United States (US).

1. The Agreement

These terms form a binding agreement between the customer and Fwankies Auto Transport LLC. The agreement takes effect when the company confirms a booking in writing, whether by email, by written confirmation or by an accepted deposit. The terms apply to the entire haul, from the moment the vehicle is released for loading until the moment it is delivered and the condition report is signed.

Where a separate written transport agreement is signed for a particular load, that document controls if it conflicts with these terms. Otherwise, these terms and the confirmed quote together set out the full understanding between the parties.

2. Services and Dispatch Role

Fwankies Auto Transport LLC arranges vehicle shipping and carrier dispatch. The company inspects vehicles at its St George yard, straps and secures loads, prepares condition records, matches loads with carriers and coordinates the route from pickup to delivery. The company may perform some moves with its own equipment and may arrange other moves through independent carriers.

The customer understands that a vehicle move involves multiple parties and that the company acts as the organizing party for the haul. The services available include open auto transport, enclosed auto transport, door to door shipping, terminal to terminal shipping, expedited vehicle dispatch and motorcycle and ATV hauling, as described on the services page.

3. Quotes and Pricing

A quote is based on the information the customer provides, including the vehicle type, the origin, the destination, the requested dates and any access limitations. The quote states the amount for the lane recommended by the desk. Prices reflect current fuel costs, carrier availability, season and the equipment required.

A quote remains valid for the period stated in the confirmation. If the customer changes a material detail, such as the vehicle, the addresses or the timing, the company may issue a revised quote. A quote becomes a booking only when the company confirms it and, where applicable, when the deposit is received.

If a vehicle does not run, does not roll, requires a forklift or needs special handling, the customer must disclose that condition before booking. Undisclosed conditions may lead to a revised price, a delay or a refusal to load, and the customer remains responsible for any reasonable cost caused by the missing information.

4. Booking and Confirmation

A booking is created when the customer accepts a quote and the company issues a written confirmation. The confirmation identifies the vehicle, the pickup and delivery locations, the agreed price, the payment terms and any special instructions. The customer is responsible for reviewing the confirmation and reporting errors promptly.

The company assigns a carrier based on the corridor, the equipment needed and the schedule. The customer receives the carrier name and driver contact before pickup. Any change to the booking should be requested through the dispatch desk so the confirmation remains accurate.

5. Payment Terms

Payment terms are stated in the quote and confirmation. A deposit may be required to hold a deck position, with the balance due before or upon delivery as specified. Accepted payment methods are listed in the confirmation and may include card, bank transfer or another method approved by the company.

The company may charge a fee for a returned payment, a late balance or a payment dispute that is resolved in the favor of the company, where the law allows such a fee. Outstanding balances may delay the release of a vehicle until the account is settled. The customer is responsible for any tax imposed on the service.

6. Cancellation and Rescheduling

A customer may cancel a booking before the carrier is dispatched. If a deposit was paid, the deposit may be refunded in part or in full depending on how close the cancellation falls to the scheduled pickup and on whether a carrier has already been committed to the route.

Cancellation after a carrier is en route or after the vehicle is loaded may result in charges for the distance traveled and for the time lost, because the carrier has reserved space and turned down other loads. Rescheduling is generally possible at no extra charge when requested with reasonable notice and when the new date fits an available lane.

If the company must cancel a confirmed haul for a reason within its control, it will offer a new date or a refund of amounts paid for the unperformed portion of the service.

7. Pickup Requirements

The customer must present the vehicle at the agreed pickup point on the agreed date, with keys, and with the vehicle in a condition that allows it to be loaded and secured. The vehicle should carry no more than a quarter tank of fuel and should be clear of loose items, alarms that cannot be disarmed and accessories that could shift during transport.

If the vehicle cannot be released at pickup because the customer is absent, the paperwork is incomplete or the vehicle is not as described, the company may reschedule and apply a fee for the wasted trip. The customer must have lawful authority to release the vehicle for transport and must confirm that right on request.

8. Delivery and Receipt

At delivery the carrier will contact the consignee to arrange a time and a safe location. The consignee must inspect the vehicle, confirm that the condition matches the pickup record and sign the delivery report. The signature acknowledges receipt of the vehicle in the recorded condition.

If the consignee is unavailable, the vehicle may be stored at a secure location at the expense of the customer until it can be collected. Delivery to a person other than the named consignee requires written authorization in advance, including the name and contact details of the receiving party.

9. Condition Reports and Inspection

A condition report is prepared at pickup and at delivery. The report records visible damage, the odometer reading and general vehicle presentation, supported by photographs. The report protects both parties by creating a shared record of the vehicle state before and after transport.

The customer should review the pickup report carefully and raise any disagreement before the vehicle is loaded. A claim of new damage must be supported by the pickup and delivery reports and by the customer condition notes. Normal road film and light dust are expected on open transport and are not treated as damage.

10. Personal Items and Prohibited Goods

Vehicles are accepted for transport as vehicles, not as moving containers. Personal belongings left inside a vehicle travel at the sole risk of the customer and are not covered by the company or by carrier insurance. The company is not responsible for the loss of, damage to or delay of any personal item left in a vehicle.

Prohibited items include firearms, ammunition, flammables, hazardous chemicals, illegal substances, living animals and any item that violates the law or the carrier policy. The customer must remove such items before pickup. The company may refuse to load a vehicle that contains prohibited goods and may report unlawful items to the proper authorities.

11. Independent Carriers

Many hauls are performed by independent carriers that operate their own trucks, trailers and insurance. The company selects carriers with care and confirms that a carrier holds the required operating authority and insurance before assigning a load. The carrier remains an independent business and is responsible for the manner in which it performs the transport.

The customer agrees that the company may share the information needed to perform the haul with the assigned carrier, as described in the privacy policy. The customer also agrees that the carrier may contact the customer directly to arrange pickup and delivery.

12. Limitation of Liability

To the extent the law allows, the liability of Fwankies Auto Transport LLC for any claim arising from a haul is limited to the amount paid for the transport of the vehicle concerned, or to the amount recoverable under the applicable carrier insurance, whichever is greater. The company is not liable for indirect, incidental, special or consequential losses such as lost profits, missed appointments or the cost of a rental vehicle.

The company is not responsible for loss or damage caused by events beyond its reasonable control, by the condition of the vehicle before transport, by mechanical or electrical failure during transport or by personal items left in the vehicle. Nothing in these terms limits any liability that cannot be limited under applicable law.

13. Damage Claims and Deadlines

A claim of damage or loss must be reported to the carrier and to the company at the time of delivery, and confirmed in writing promptly afterward. Prompt reporting allows the company to inspect the vehicle, compare the condition reports and work with the carrier and the insurer while the facts are fresh.

The customer should keep all documents, photographs and receipts connected to a claim and should not repair the vehicle before the claim is documented, unless the repair is necessary to prevent further damage. The company will help document a legitimate claim and will provide the carrier information needed to pursue it.

14. Delays and Force Majeure

Vehicle transport is affected by weather, traffic, road closures, mechanical breakdowns, customs delays and other events that no party can fully control. Estimated pickup and delivery dates are given in good faith but are not guaranteed unless a booking states otherwise in writing.

The company is not liable for a delay caused by a force majeure event, by the actions of a government body or by circumstances beyond its reasonable control. When a delay occurs, the company will inform the customer, explain the cause and provide a revised estimate as soon as one is available.

15. Insurance and Coverage

Carriers are expected to carry insurance that covers vehicles in transit, and the company confirms coverage before assigning a load. The customer should also maintain personal coverage on the vehicle during transport, because carrier coverage may be limited in amount and may exclude certain causes of loss.

Where a claim exceeds the carrier coverage limit, the customer may need to rely on a personal policy. The company can provide documentation of the carrier coverage on request so that a customer can make an informed decision before booking.

16. Customer Conduct and Accuracy

The customer agrees to provide accurate and complete information about the vehicle, the addresses and the people authorized to release and receive the unit. Inaccurate information may lead to a revised quote, a delay or a cancelled booking, and the customer is responsible for reasonable costs caused by the inaccuracy.

The customer agrees to treat the dispatch staff and carrier personnel with courtesy and to communicate promptly about any change. Abusive conduct, threats or attempts to mislead the company about a vehicle or a payment may lead to cancellation of the service and to a refusal of future bookings.

17. Acceptable Use of the Website

The website is provided for lawful purposes connected with vehicle shipping. A visitor may browse the pages, submit a genuine quote request and contact the desk. A visitor may not attempt to disrupt the site, gain unauthorized access, scrape content for reuse or submit false or abusive material through any form.

The company may suspend access to the website or decline a booking where it reasonably believes that the site or the service is being misused. The company may also cooperate with authorities where unlawful activity is suspected.

18. Intellectual Property

The text, layout, graphics, styling and structure of this website belong to Fwankies Auto Transport LLC or are used with permission. A visitor may print or save pages for personal use connected with a booking. A visitor may not copy, republish or redistribute substantial parts of the site for commercial purposes without written permission.

The business name, the trade name and any associated marks belong to the company. Nothing in these terms grants a license to use those marks except as needed to refer to the company and its services in a truthful and non confusing way.

19. Privacy and Data

The handling of personal information is described in the privacy policy, which forms part of these terms. The privacy policy explains what is collected, why it is collected, who may see it and how a customer can exercise privacy rights. By booking a haul, the customer confirms that the privacy policy has been made available.

Information is shared with carriers and service providers only as needed to perform the haul and to run the business. The company does not sell personal information and does not use booking details for unrelated advertising.

20. Dispute Resolution

If a disagreement arises, the parties should first try to resolve it directly and in good faith. The customer should contact the dispatch desk with the booking number, the relevant documents and a clear description of the issue. The company will review the file, respond in writing and propose a resolution.

If direct discussion does not resolve the matter, the parties may agree to mediation before pursuing other remedies. Any formal proceeding is subject to the governing law and venue described below. Nothing in this section prevents a party from seeking urgent relief where the law allows it.

21. Governing Law

These terms are governed by the laws of the State of Utah in the United States, without regard to conflict of law rules. Any dispute that proceeds to court is to be brought in a court of competent jurisdiction in Utah, unless applicable law requires a different venue.

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force. The unenforceable provision will be replaced by a valid provision that best reflects the original intent.

22. Changes to These Terms

The company may update these terms to reflect changes in the services, in the law or in business practice. A material change will be posted on this page with a revised effective date. A booking is governed by the terms in effect on the date the booking is confirmed.

Continued use of the website or continued booking of hauls after a change indicates acceptance of the revised terms. A customer who does not agree to a change should raise the concern with the dispatch desk before the next booking.
